Terms of Service

1 Agreement to Terms

By accessing or using the services provided by All Hands Construction LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access our services or website.

These Terms apply to all visitors, users, and others who access or use our construction, roofing, and masonry services in New Jersey. Our NJ License (#13VH11691400) governs our professional conduct, but these Terms govern the contractual relationship between you and the Company.

2 Services Description

All Hands Construction LLC provides residential and commercial construction services, including but not limited to:

• Roofing installation, repair, and replacement.
• Masonry work, including bricklaying, stone work, and concrete structures.
• Gutter installation and maintenance.
• General contracting and project management.

We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice. Specific service availability may vary based on location, season, and resource allocation.

3 Estimates and Contracts

All estimates provided by All Hands Construction LLC are preliminary and subject to change upon final inspection and material selection. A binding agreement is only formed when a written contract is signed by both parties.

• Validity: Estimates are valid for 30 days from the date of issuance unless otherwise stated.
• Changes: Any changes to the scope of work after contract signing may result in additional costs and timeline adjustments, documented via Change Orders.
• Permits: Unless explicitly included in the contract, obtaining necessary building permits is the responsibility of the homeowner. We can assist in this process for an additional fee if requested.

4 Payment Terms

Payment schedules are outlined in individual contracts. Generally, we require:

• A deposit upon contract signing to secure materials and scheduling.
• Progress payments at predefined milestones during the project.
• Final payment upon completion and final inspection.

Late payments may incur interest charges as permitted by New Jersey law. We accept major credit cards, checks, and bank transfers. Failure to make timely payments may result in work stoppage until the account is current.

5 Warranties and Guarantees

We stand behind our workmanship. Specific warranty terms depend on the service provided and are detailed in your contract. Generally:

• Workmanship Warranty: We offer a limited warranty on our labor for a period specified in the contract (typically 1-10 years).
• Manufacturer Warranty: Materials used (shingles, bricks, etc.) are covered by their respective manufacturer warranties. We assist in filing claims but are not responsible for manufacturer defects.
• Exclusions: Warranties do not cover damage caused by natural disasters, neglect, improper maintenance by the homeowner, or modifications made by other contractors.

6 Limitation of Liability

To the fullest extent permitted by law, All Hands Construction LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising out of or related to our services.

Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim. We are not liable for delays caused by force majeure events such as extreme weather, strikes, or supply chain disruptions.

7 Indemnification

You agree to defend, indemnify, and hold harmless All Hands Construction LLC, its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of our services or any violation of these Terms.

8 Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.

Before initiating legal action, both parties agree to attempt good-faith negotiation to resolve the dispute. If negotiation fails, mediation may be pursued as a cost-effective alternative to litigation.
